At the meeting of the Yates County Planning Board July 27, the board approved three applications from the Village of Penn Yan related to the planned construction of a Tractor Supply store.
The site on Rte. 14A just south of Penn Yan, was recently annexed into village to provide the municipal utilities required.
Rod Ives, engineer with Napierala Consulting and the authorized representative for the McFetridge Family Trust, requested a Site Plan Review, to build the 19,097 sq. ft. Tractor Supply building with a 74-car parking lot; an Area Variance to install both a 25 ft. tall monument sign of 99 sq. ft. as well as a building sign of 48 sq. ft.; and an Area Variance to allow for 74 parking spaces instead of the 122 spaces required by code for a building of that size.
Board member Ron Rubin was the sole vote opposing the project, asking, “How many of these businesses do we want?” Rubin said he believes development like this is contrary to the county’s master plan, and that the county legislature or the planning board should restrict it. Fellow board members Herb Snyder and Chuck Mitchell disagreed with Rubin, stating the benefits of competition and increased tax revenue, and that it is not the county’s business to decide on the marketing or potential customers of a legitimate business. The motions passed with the language that there was “no county-wide or intermunicipal impact” by the project.
The following applications were also approved:
• Town of Milo applicant YMCA of Greater Rochester’s “Camp Cory” at 140 Rte. 54 / E. Lake Road, for a Special Use Permit to expand the day and overnight camps and construct new buildings and amenities on adjacent land recently acquired by the camp. The motion was passed with the language that the expansion of the camp would have “a positive county-wide or intermunicipal impact.”
• Town of Starkey applicants Frederick & Maressa Merwarth of Hermann Wiemer Winery, for a Site Plan Review to build a new residence with an in-law apartment. Their existing home in the original Italiante house will become offices for the winery.
• Town of Middlesex applicant Benjamin Dunton, of 1032 Route 364, for an Area
Variance for a two-story 20 ft. X 28 ft. addition on existing residence with a pre-existing non-conforming road setback from a state highway.
