Includes reports received from Yates County Sheriff’s Department, Penn Yan Police Department, and New York State Police. It should be noted that these reports merely indicate that someone has been charged with an offense, and the use of the term “arrest” does not always mean someone was put in jail. These reports do not indicate guilt. 

Albert M. Zuzio, 46, of Sherburne, was arrested Jan. 20 by Sherburne Police executing a warrant issued by Torrey Town Court in 2018. He is charged with breaking into and stealing from a business in May 2018. He was turned over to Yates County Sheriff’s Office Deputies (YCSO), brought to Yates County Centralized Arraignment Court, and was remanded to the county jail.

A 16-year-old youthful offender was arrested Jan. 21 by Penn Yan Police Department Officers (PYPD) following investigation of an assault on another youth that occurred Dec. 20. The offender allegedly attacked and injured the victim. The youthful offender was charged with endangering the welfare of a child and 3rd degree assault, issued appearance tickets for Yates County Probation, and was released to a guardian.

Tyler G. Wheaton, age 23, of Penn Yan, was arrested Jan. 22 by PYPD following a domestic complaint. Wheaton allegedly got into an argument with another village resident and during the altercation, Wheaton allegedly smashed the victim’s phone and attempted to prevent the resident from calling 911, all in the presence of a 4-year-old child. Wheaton was charged with 3rd and 4th degree criminal mischief and endangering the welfare of a child. He was held for Arraignment Court to be served with an order of protection, and was released.

Matthew A. Simmons, 43, of County Rte. 22, Beaver Dams, was arrested at 11:57 p.m. Jan. 22 by YCSO following a traffic stop. Noting the odor of marijuana from the vehicle, Deputies discovered a bag containing marijuana and hashish along with other drug paraphernalia on the back seat. Simmons was charged with 2nd and 4th degree criminal possession of marijuana, and was released with appearance tickets for Milo Town Court.

Zachary T. Druker, 31, of Waugh Road, Dundee, was arrested Jan. 23 by YCSO after allegations he tampered with a witness on two recent dates while incarcerated in the county jail. He was charged with two counts of 4th degree witness tampering and will answer in Penn Yan Village Court.

Jeremy E. Danielewicz, 25, of Fulton, was arrested Jan. 23 by YCSO following a traffic stop. A license check showed his to be under six suspensions, and he was found with marijuana. He was charged with 2nd degree aggravated unlicensed operation (AUO), 2nd degree unlawful possession of marijuana, driving an uninspected vehicle, and an exhaust leak. He was held for arraignment court and was released to answer in Torrey later.

Aurel Jovanov, 34, of Penn Yan, was arrested Jan. 23 by PYPD responding to a residence where he was reported to be present in violation of a court order of protection for the occupants. Upon arrival, PYPD was directed to a bedroom where Jovanov was, but he fled from a window. He led PYPD and YCSO on a foot chase through streets, over multiple fences, and through backyards until he was finally taken into custody. He was charged with two counts of 2nd degree criminal contempt, resisting arrest, 2nd degree obstruction, and 2nd degree harassment, and was held held at the county jail to await arraignment.

A one-car accident occurred at 7:15 a.m. on County House Road in Jerusalem. Desiree A. Petersen, 29, of Belknap Hill Road, Branchport, swerved to avoid an animal, went into a ditch, overturned, and struck a mailbox. Petersen was able to free herself from her seatbelt, and removed child passengers Trinity Kerrick, 11, and Elliot Kerrick, 5 months. YCSO, Penn Yan Ambulance Corps, Medic 55, and Branchport Keuka Park Fire Dept. responded. Petersen and the children were taken to Soldiers & Sailors Memorial Hospital for treatment of minor bumps and bruises. 

Ashley A. Montgomery, 37, of Benham St., Penn Yan, was arrested for drunk driving Jan. 24 by PYPD following a traffic stop. She was found to be intoxicated and a breath test at the county jail showed a .16 percent BAC, twice the legal limit. She was charged with DWI and speeding 51 mph in a 30mph zone, and was released with appearance tickets for village court.

Steven K. Howell, 32, of Millard St., Dundee, was arrested Jan. 24 by PYPD for 2nd degree unlawful possession of marijuana after a traffic stop where police found him with marijuana resin and a glass pipe with residue. He was processed and released with an appearance ticket.

Timothy J. Bennett, 51, of Penn Yan, was arrested Jan. 24 by PYPD after a reported fight at a residence where he made unwanted physical contact with another person multiple times. He was charged with 2nd degree harassment, processed, and released to answer later in village court. 

A two-car accident occurred Jan. 24 on Lovejoy Road in Benton. Nash D. Ridley, 18, of N. Seneca St., Waterloo, was driving north and attempted to turn into a private drive, but struck the oncoming vehicle of Melanie A. Gleason, 20, of Lovejoy Road. Gleason’s vehicle went off the road and struck a utility pole, snapping off its top. YCSO, Benton and Bellona Fire Depts., Penn Yan Ambulance Corps, and Medic 55 responded. Gleason was taken to Soldiers & Sailors Memorial Hospital for treatment of chest pain. Ridley was charged with failure to yield the right of way, and will answer in Benton Town Court.

Anthony Johnson, 19, was charged with unlawful possession of marijuana Jan. 24 after being stopped by YCSO for a load muffler in Penn Yan. He was released with appearance tickets for village court.

A one-car accident occurred Jan. 25 on Rte. 14A near Porters Corners Road in Barrington. YCSO reports Angela S. Nemeth, 54, of Highland Dr., Dundee, was not injured, but a license check showed hers to be suspended. She was charged with 3rd degree AUO and released with an appearance ticket.

Rebecca A. Andersen, 43, of Lincoln Ave., Penn Yan, was arrested Jan. 25 by PYPD after investigation showed she had sent threatening text messages to a subect, causing her to fear for her safety. The subject requested a stay away order of protection. Anderson was charged with 2nd degree aggravated harassment and was held at the county jail to await Arraignment Court. 

Timothy J. Bennett, 51, of Penn Yan, was arrested again Jan. 25 by PYPD after they received a complaint he was violating a court order of protection. Police found him at the protected person’s residence and discovered he had also been contacting the person by phone, another violation of the order. Bennett was charged with two counts of 2nd degree criminal contempt as well as an aggravated family offence (class E felony) stemming from the new charges and a previous conviction. Police say that due to the new bail reform, he was released with an appearance ticket rather than held for arraignment as he would have been released with no bail set. 

A one-car accident occurred Jan. 26 on Rte. 54 near Stiles Road east of Penn Yan. YCSO reports Rachel Dillon, 23, of Stark Ave., Penn Yan, went off the north side of the highway, struck an embankment, became airborne, and landed back in the westbound lane of the highway. Penn Yan Fire Dept.and Ambulance Corps responded, finding Dillon already out of the vehicle with a facial abrasion. She was checked over by EMS, but refused further treatment. No charges were made.
