Waterfront zoning will be topic of Penn Yan hearing

The Penn Yan Village Board’s Dec. 21 regular meeting will include a public hearing on a local law amending the village’s zoning code relating to Waterfront Development and Conservation District regulations.

The new regulations are being created in anticipation of development along the Keuka Outlet and Lake waterfront.

The regulations spell out specific definitions and requirements for construction and land use in the area. Included are specific requirements for docks and waterside structures.

Here are some of the elements of the code:

• All properties in the district shall provide a pedestrian easement for a walking trail that connects existing trails or provides the ability to connect future trails on adjacent properties.

• There are specific guidelines for lighting, utilities, buffering, parking, landscaping and architectural review.

• Special uses in the district include amusement game center, artist’s loft, a cultural facility that is related to the waterfront, manufacturing with accessory showroom,  day care center (accessory use only), private parking lot, parking structure (accessory use only), research laboratory associated with waterfront. All other commercial uses will be subject to a case by case review by the village planning board.

The code includes specific guidelines for the construction of structures in, on or over the Keuka Lake Outlet.

Permitted residential uses include clustered residential projects, single family dwellings, two family and multi-family dwellings, Bed and Breakfast Inns, dwellings above first floor businesses, townhouses and senior citizen housing.

Permitted general uses include public parks and recreational uses, public utilities or transportation uses. .

Permitted business uses include antique and craft shops, art gallery, artist studio, bank, financial institution and ATM, bar/nightclub, barber/beauty shop, hotel and motel, general business office, photographic studio, professional offices, professional office building and standard restaurant.

The entire proposed law is available for review at the Penn Yan Village Hall.
