Penn Yan Police report for July 1, 2009

Marshall J. Elwell, 47, of 122 Cornwell St., Penn Yan, was charged on June 22 with attempted rape (second degree), a class E felony and three counts of sexual abuse (a class A misdemeanor).  The arrest is the result of an ongoing investigation alleging Elwell attempted to engage in sexual intercourse with a female under the age of 14.  It is also alleged that he subjected two other females under the age of 14 to sexual contact on different occasions. Elwell is  being held at the Yates County Jail on bail from a previous charge filed on June 15.  His bail is continued at $5,000 cash or $10,000 bond for Grand Jury action.

James A. Conn, 24, of 210 E. Elm St., Penn Yan, was arrested on June 23 for unlawful possession of marijuana.  Conn was issued an appearance ticket and released.

Eric L. Lancaster, 42, of W. Main St., Palmyra, was arrested on June 28 for DWI, failure to signal and failure to stop at a stop sign.  Lancaster was stopped shortly after midnight on Liberty Street for the traffic charges.  He was arraigned in Benton Town Court and remanded to Yates County Jail in lieu of $1000 cash/$2000 bond.  He was to appear in village court on June 29.
