Yates County Grand Jury indictments

The following defendants were recently indicted by the Yates County Grand Jury:

• Billy Dunham, 25, of 103 Hutton St., Penn Yan, was indicted on charges of burglary in the second degree and criminal possession of stolen property in the fifth degree, arising out of an incident in the Village of Penn Yan on June 30, 2010. Dunham was arraigned on Nov. 23 before W. Patrick Falvey.  A pre-plea report was ordered from the probation department and Dunham was remanded to jail without bail.  The matter was adjourned pending completion of the report and pre-trial motions.

• Jeremy Lee Glazier, 36, of 305 Clinton St.was indicted on charges of assault in the second degree, arising out of an incident at his home on Oct. 10.  He was arraigned on Nov. 8 before Falvey and bail was set at $5,000 cash/$10,000 bond.  The court also issued an order of protection prohibiting Glazier from having any contact with the victim.  A pre-plea report was ordered from the probation department and Glazier was remanded to jail in lieu of bail.  The matter was adjourned pending completion of the report and pre-trial motions.

•  Todd J. Holton, 34, of 2036 Mays Mills Road, was indicted on two counts of felony DWI, arising out of an incident in the Town of Benton on Sept. 22.  Holton was arraigned on Nov. 23 before Falvey and bail was set at $2,000 cash/$4,000 bond.  A pre-plea report was ordered from the probation department and Holton was remanded to jail in lieu of bail.  The matter was adjourned pending completion of the report and pre-trial motions.

• Tracey E. Thomas, 38, of 14 Millard St., Dundee was indicted on multiple counts of felony aggravated DWI and endangering the welfare of a child, the result of an incident in the Village of Dundee on Sept. 8. Thomas was arraigned before Falvey on Nov. 23. A pre-plea report was ordered from the probation department and Thomas was released on her own recognizance. The matter was adjourned pending completion of the report and pre-trial motions.

•  Richard A. Regan III, 40, of 1371 City Hill Rd. Penn Yan, was indicted on 13 felonies and a total of 35 different criminal counts, including charges of criminal possession of a weapon second degree, criminal possession of a weapon third degree, criminal use of a weapon second degree, criminal sale of a firearm third degree, unlawful possession of marijuana, illegal transportation of firearms, menacing second degree, criminal possession of stolen property, criminal possession of a weapon fourth degree and criminal contempt second degree.  All charges are the result of an incident at his home in the Town of Milo in June 2010.  Regan was arraigned in Yates County Court on Dec. 16 before Judge Dennis Bender.  Bail was set at $4,000 cash/$8,000 bond.  The matter was adjourned for completion of report and pre-trial motions.

•  Samuel Ortiz, 46, of 111 Highland Dr., Penn Yan was indicted on one count of felony DWI, arising from a matter in the Village of Penn Yan on June 26.  Ortiz was arraigned on Dec.16 before Bender.  Bail was set at $7,500 cash/$15,000 bond and a pre-plea report was ordered from the probation department.  The matter was adjourned for completion of the report and pre-trial motions.

•  Andrew B. Golden, 21, of 111 Main St., Dundee was indicted on felony charge of criminal possession of marijuana in the second degree, arising out of a matter in the Town of Starkey on Sept. 21.  Golden was arraigned on Dec. 16 before Bender and the defendant was remanded without bail, as he is presently serving a state prison sentence on an unrelated matter out of Schuyler County Court.  A pre-plea report was ordered from the probation department.  The matter was adjourned for completion of the report and pre-trial motions.

• Tammy M. Davis, 29, of 3222 Delooza Rd., Penn Yan was indicted on two counts of felony DWI, arising out of a matter in village court on Sept. 26.  Davis failed to appear for arraignment on Dec. 16.  She was scheduled for arraignment on Dec. 20.  If she failed to appear a warrant will be issued by the court.

•  Thomas Rexford, 17, of 120 Eagle Lane, Apt. 35, Penn Yan, was indicted on a felony count of grand larceny in the third degree, arising from a matter in the Village of Penn Yan on Nov. 8.  Rexford was arraigned on Dec. 16 before Bender.  Bail was set at $2,500 cash/$5,000 bond and a pre-plea report was ordered from the probation department.  The matter was adjourned for completion of the report and pre-trial motions.

‚•  Juan C. Estevez-Santos. 24 of 1114 South Main St., Apt. 14, Newark, was indicted on felony counts of criminal use of a firearm in the second degree, attempted assault in the first degree, reckless endangerment in the first degree, menacing in the second degree and prohibited use of weapons, all arising out of an incident on State Route 14 on Sept. 19.  He was scheduled to be arraigned on Dec. 20 before Bender.
